These general conditions of sale are governed by the Consumer Code (Legislative Decree. N. 206/2005), Section II “Distance contracts” and the rules on electronic commerce (Legislative Decree. N. 70/2003 ).

Content of online offer and end client specifications.

All customers who place an order of annabaiguera ballet shoes establish a business relationship with Lemco Srl and are committed, therefore, to accept delivery of the material ordered online.

The online offer conditions apply exclusively to purchases made on the website.

Lemco Srl manages the online sale of annabaiguera products in order to offer them for sale exclusively to the End Client. End Client means a natural person acting for purposes unrelated to business or professional activities and who does not resell goods purchased on annabaiguera.com. Lemco Ltd. therefore demands that all Customers that do not fit in the aforementioned category of End Client refrain from placing orders, whether directly or through third parties. In view of the commercial policy described above, we reserve the right not to process orders from persons who are not End Clients or orders that do not comply with commercial policies.

Customer requirements

To place orders on the website annabaiguera.com Clients must:

  • Be End Clients be as defined by the commercial rules on annabaiguera.com:
  • Be at least 18 years of age;
  • Be eligible to enter into legally binding contracts;
  • Have an e-mail address;
  • Owning a credit card or a PayPal account valid for payment;
  • Be domiciled in the Continental region or in the major islands of one of the following EU countries: Austria, Belgium, Bulgaria, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, the United Kingdom (UK), Czech Republic, Romania, Slovakia, Slovenia, Spain, Sweden, Hungary.

Prices

Prices shown on the website are inclusive of VAT, excluding delivery costs which will be highlighted, separately, when required at the time of order.

The price that will apply The products is indicated on the site at the time of receipt of the Customer.

Payment methods

Payment can be made online by credit card or PayPal account payable to the customer as indicated on the website.

The amount corresponding to the products purchased will be charged to the Client at the same time of Purchase Order.

Standard Order

The contract will be concluded upon receipt of the order by Lemco Srl. Once availability of the product ordered has been confirmed, Lemco Srl will send the Client the order confirmation.

Occasional unavailability of products on offer may occur; if so, Lemco Srl will communicate this to the Client, specifying any alternatives or the maximum turnaround times for the temporarily unavailable Product/s.

Product Order on request

The shoes are specifically made to order according to customer request: they are not available for shipping, but are specially manufactured and customised for each individual order. Therefore the shoes are produced on request and not ordered simply by size.

Because of this customisation, the shoes ordered are not refundable or replaceable, as they are produced exclusively.

The buyer must be sure of the fit and the size to order.

For this purpose, after placing an order the buyer will receive a prototype created ad hoc and free, exclusively to test the fit. The prototype must be returned to Lemco Srl, at its cost. Following the prototype’s return and size confirmation, the shoes will be made. If the prototype is not returned, the order will be canceled and the amount paid by the purchaser for the cost of its production will be withheld, amounting to € 100.

The expected delivery time is a minimum of 15 working days from the date the size is confirmed.

The entirely artisanal character of the product makes Lemco Srl unable to ensure compliance with this deadline.

A delay in the production or delivery cannot be grounds for cancellation of the order or a refund.

Payment must be made for the full amount at the time of the order. Once the order is placed, it will undergo an internal feasibility verification: if raw materials are lacking, or for causes of force majeure it is impossible to produce the shoes, the order can be canceled by us and the buyer will be fully refunded.

A special customisation is also included: next to the annabaiguera logo a maximum of four (4) chosen digits can be printed (e.g. the initials of a name or a date in a reduced size), to be communicated along with the order. This customisation is obligatory: if no information is provided regarding said customisation, the buyer’s initials will be printed on the shoes.

Shipment Tracking

At the time of shipment, Lemco Srl will send their customers an email with the tracking number through the courier used.

Order Status

Customers can receive information on the status of their order by sending an email to info@annabaiguera.com or by accessing the “My Account” section on the site if they have created such account when ordering.

Order Modifications

We wish to remind our customers that once orders have been confirmed and processed, cannot be changed.

Orders placed separately will be shipped separately as well.

Shipping

The shipment of goods will be made at the expense of Lemco Srl, via express courier economy delivery, at the address indicated in the on-line order.

Lemco Srl cannot be held liable for delays in delivery.

The carrier will make two attempts to deliver the products to the address specified by the Client. Should the attempts be unsuccessful and should the Client fail to take steps to recover the shipment from the carrier, the goods will be returned to Lemco Srl at the Client’s expense. These amounts will be deducted from any refund due to the Client by Lemco Srl.

Upon receipt of the goods, customers are requested to carefully inspect the parcel before signing proof of delivery. The annabaiguera packages are carefully packed in a cardboard box and sealed with plastic package. If for any reason, the package appears tampered or if the tape is not intact, customers are asked to sign the receipt subject to checking, or to refuse delivery. Once the delivery document has been signed, the Client can no longer make any objections on the appearance of the delivered products.

The Client agrees to verify the correctness of their data and to immediately notify Lemco Srl of any errors. Any extra charges caused by errors in the data that are not promptly reported will be the sole responsibility of the Client. If for any reason the shipment cannot be successfully delivered to the address provided by the Client in the commercial contract, the parcel will be returned to the sender at the expense of the Client. These amounts will be deducted from any refund due to the Client by Lemco Srl.

Returns

If for any reason the customer is not satisfied with an order, items that are intact and not used and have not been produced on request and customised, may be exchanged on demand with a different size, style change or refund, within 14 days of delivery.

In such cases, the customer must send a request to info@annabaiguera.com promptly and within 14 days from receipt of order. The e-mail should specify item codes for items to be returned and desired compensation: size change , colour, style changes, or refund of the price paid for the goods ordered that need to be returned. Upon receipt of the request made annabaiguera will send the Client a written confirmation.

In any case of written confirmation by Lemco Srl refund, the Client must return the goods within the following 15 days.

In the procedure to return goods of equal or greater value or different size, the return delivery is free provided the return is done via a courier commissioned by Lemco srl. We therefore ask Clients to please indicate in the authorisation to return email : date, time and address where the courier should receive the items.

There is only one free exchange of goods of equivalent or higher value for each order (provided that it complies with the above return conditions).

The refund will appear on the Client’s credit card statement after a minimum of 30 days from the date of refund. Timing may vary slightly depending on the banking system of the credit card used.

If the customer wishes to personally return the goods or through another carrier, goods must be sent to the headquarters of Lemco Srl – Via degli Artigiani 17 / bis – (25029) Verolavecchia (BS) Italy – within 15 days from written authorisation sent to the Customer by the returns department. In all the above cases, the shipping costs for return will be borne entirely by the Client.

The right of withdrawal is subject to the following conditions:

The shoes can only be returned if unused. Each pair must also include all packaging accessories (Box, Cotton bag, kit-care, accessories) received together with the order. All footwear must be returned together with their original box, which is considered in all respects an integral part of the product itself and that must not be in any way damaged and / or altered.

Shoes produced on request and thus customised cannot be returned.

The shoes must be returned within fifteen days of confirmation to return. Shipping is at the sole risk and responsibility of the Client.

Refund for defective goods

In the event that the Client receives defective goods, or errors in shipment by Lemco Srl, the Client is required to follow the same instructions mentioned above.
All pairs returned are subject to inspection by Lemco Srl and must comply with the parameters listed in the return process. Lemco Srl reserves the right to charge 25% of the value of the returned goods in cases where the return does not comply with all terms and conditions provided for by the above conditions and the law.
Lemco Srl reserves the right to refuse unauthorised returns or returns shipped with any carriers other than those agreed. The acceptance of such returns may result, however, in a charge equal to 25% of the value of the returned goods.

Privacy

Lemco Srl – with registered office in Via degli Artigiani 17 / bis – 25029 Verolavecchia (BS) Italy – the creator and promoter of the business available on the site annabaiguera.com, reserves the right to use the personal data voluntarily provided by users, in compliance with the regulations (Articles 13 et seq. Legislative Decree no. 196/2003).

Accordingly, we invite users to visit this page for updates related to modifications in current legislation.

Lemco S.r.l. guarantees users that their personal data will be processed exclusively for purposes connected to the provision of services, facilitation of site management and the execution of orders. The data voluntarily provided by users, will in no case be disclosed to third parties, except when in accordance with contractual enforcement activities.

The personal data will be processed by Lemco Srl through the use of both paper and electronic means, in compliance with current safety standards, for purposes which will be specified in each case.

The request for the above-mentioned information can be renewed within a minimum 90-day interval, except in case of right cause: cancellation or modification of such data due to breach of law; cancellation of data that cannot be used for the purpose for which it was collected.

Competent Court of Dispute

Any disputes will be resolved before the competent judicial authority under applicable law.
Should the legislation on mediation apply, the parties agree to refer the complaint to the mediation body at the Chamber of Commerce of Brescia, or in the Client’s city of residence.
